Terms of Service

    I. General Provisions

    These Terms of Service set out the rules for using the website at egzekucja.com (hereinafter: Website) and services provided electronically by Egzekucja spółka cywilna Ryszard Rudzki, Andrzej Kraś with its registered office in Zielona Góra (65-602), ul. Miodowa 2b (hereinafter: Service Provider).

    Using the Website means acceptance of these Terms of Service and the Privacy Policy.

    II. Definitions

    For the purposes of these Terms of Service, the following definitions apply:

    Usera natural person, legal person, or organizational unit without legal personality using the Website.
    Clienta User who has entered into a contract with the Service Provider and has access to the Client Panel or Client Zone.
    Client PanelIT system available at panelegzekucja.com, enabling the submission of debt collection cases.
    Client ZoneIT system available at onlineegzekucja.aspnet.pl, enabling case status monitoring.
    Servicesservices provided electronically by the Service Provider, including access to the Website, contact form, and client panels.

    III. Terms of Website Use

    To use the Website, the following are required:

    • a device with Internet access,
    • a web browser supporting JavaScript and cookies,
    • an active email account (when using the contact form).

    The User undertakes to use the Website in accordance with applicable law, principles of social coexistence, and these Terms of Service.

    Prohibited actions:

    • taking actions that may disrupt the Website's operation,
    • using the Website for unlawful purposes,
    • providing false data in forms,
    • automatically downloading content from the Website without the Service Provider's consent.

    IV. Terms of Client Panel Use

    Access to the Client Panel and Client Zone is available only to Clients who have entered into a contract with the Service Provider and received login credentials (username and password).

    The Client undertakes to:

    keep login credentials confidential

    not share the account with third parties

    immediately inform the Service Provider of suspected unauthorized account access

    use the panels in accordance with their intended purpose

    The Service Provider reserves the right to block account access in case of violation of these Terms of Service or suspected unlawful activities.

    Data processed in Client Panels is protected in accordance with GDPR and the Privacy Policy.

    V. Contact Form

    The Website enables sending inquiries via the contact form. Providing personal data (name, surname, email address) is voluntary but necessary to respond to the inquiry.

    VI. Intellectual Property

    All content on the Website, including texts, graphics, logos, photos, page layout, and software, is the property of the Service Provider or entities with whom the Service Provider has concluded relevant agreements, and is protected by copyright and industrial property law.

    Note: Copying, distributing, modifying, or using content from the Website without the written consent of the Service Provider is prohibited.

    VII. Liability

    The Service Provider makes every effort to ensure that information on the Website is up-to-date and accurate. Content on the Website is for informational purposes and does not constitute legal advice.

    The Service Provider is not liable for:

    • temporary Website unavailability due to technical work or failures
    • damages resulting from using the Website contrary to the Terms of Service
    • content posted by Users (e.g., in forms)
    • actions of third parties, including hacking attacks
    • consequences of sharing login credentials with third parties by the Client

    VIII. Complaints

    Complaints regarding the Website's operation or services provided may be submitted:

    The complaint should include a description of the problem and contact details enabling a response. The Service Provider processes complaints within 14 business days.

    IX. Changes to Terms of Service

    The Service Provider reserves the right to amend these Terms of Service. Users will be informed of changes by publishing a new version of the Terms of Service on the Website.

    Using the Website after changes take effect means acceptance of the amended Terms of Service.

    X. Out-of-Court Dispute Resolution

    In accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council, we inform you of the possibility of using the ODR (Online Dispute Resolution) platform available at: https://ec.europa.eu/consumers/odr

    The ODR platform is used to resolve disputes between consumers and traders regarding contractual obligations arising from online contracts.

    Information: The Service Provider informs that the services provided are of a professional nature (B2B) and are primarily aimed at businesses.

    XI. Final Provisions

    In matters not regulated by these Terms of Service, Polish law applies, in particular the Civil Code and the Act on the Provision of Electronic Services.

    Any disputes arising from the use of the Website shall be resolved by the court having jurisdiction over the Service Provider's registered office.

    These Terms of Service enter into force on the date of publication on the Website.
